In Germany, mobile phone producer, HTC, has been ordered to stop selling its 3G phones. Ipcom made this request. However, HTC has already stated their refusal to comply. Patent owner, Ipcom had previously taken HTC to court over this matter. The claim made by Ipcom was ruled invalid a year ago in a German Federal Patents court.
Many experts disagree with the court’s ruling. They cite that following such will shut them out of a market where they have a large presence.

The dispute centers around a wireless patent that has initially been obtained by a German group, Bosch, for a car telephone system. However, in 2007, Bosch sold their rights to this patent to Ipcom. Two years following the sale, Ipcom challenged HTC’s usage of the technology. A German court placed an injunction on HTC. The ruling was of course challenged by HTC. The second court suspended the injunction until an additional hearing could be held. This reconsideration was supposed to occur recently. However, HTC withdrew their claim.

Ipcom now is determined that the ban be enforced. They supported their stance by citing that HTC never did attempt to make an offer to settle the issue. Therefore, Ipcom is going to go ahead and request the original ruling to be enforced since HTC withdrew their appeal. This could mean that HTC mobile phones such as the Desire, Sensation and Wildfire could be removed from shelves.

Ipcom is prepared to ask that HTC be fined if they refused to comply with original injunction. Ipcom is willing to withdraw the request provided that HTC would pay a fair price for the license. Other telecom companies have done so with Ipcom. However, HTC remains unwilling to do so. A spokesperson reported that the company feels that it does not need to meet these demands.
